AICD submission to Treasury on improving protections for corporate whistleblowers

On 21 December 2009, AICD provided a submission to Treasury regarding the Options Paper entitled Improving Protections for Corporate Whistleblowers. AICD’s submission stated that:
- the good faith requirement under the current whistleblower protection provisions in the Corporations Act should be retained;
- the ability of prospective whistleblowers to seek legal advice (even though it may assist prospective whistleblowers to make better decisions as to disclosures) should be the subject of further analysis;
- the fact that there have been few reports made under the current whistleblower protection provisions of the Act is not an indication that the current provisions have failed.
AICD recommends that where possible, employees first utilise and exhaust the internal risk reporting mechanisms and procedures corporations have put in place.
