Governance of Tasmanian Health Organisations

This submission to the Tasmanian Department of Health and Human Services is in response to the Draft Tasmanian Health Organisations Bill 2011 (the Draft Bill), released on 11 August 2011.

While some of the aspects of the Draft Bill represent an improvement on similar legislation that has been progressed in other Australian states, we expressed concerns that certain key aspects of the proposed reforms did not align with what is widely regarded as good practice in corporate governance.

Among other things, the submission put forward that there is a need to reduce the ways and degree by which the Government is able to intervene in the governance and operations of Tasmanian Health Organisations (THOs), and that more needs to be done to ensure that appointments to THO governing councils occur in a transparent manner, with individuals who have appropriate skills, backgrounds and experience for governing a large and complex organisation such as a THO.
